TIMES Attorneys won before the Swiss Federal Supreme Court

TIMES Attorneys (Andrea Mondini) successfully represented Mepha Pharma AG (the Swiss subsidiary of Teva Pharmaceuticals) in patent infringement proceedings against Novartis regarding a generic version of Novartis’ product Jadenu® (deferasirox).
On appeal, the Swiss Federal Supreme Court affirmed the Swiss Federal Patent Court’s judgment holding that Deferasirox Mepha does not infringe Novartis’ patents. This is a landmark case under Swiss law on the issue of equivalent infringement of numerical ranges.

New Publication by Dr Stephan Netzle

In his recent publication in the SpuRt, Dr Stephan Netzle addressed the most important findings in the Semenya-judgement of the European Court of Human Rights. In the previous Semenya-Award, the CAS has already correctly applied the ECHR principles, however without explicit reference to the ECtHR jurisprudence. It is expected that this will change in the future. And the Swiss Federal Tribunal might expand its limited scope of review of CAS decisions in cases where a sports governing body is accused of having discriminated an athlete.

Mirjam Koller-Trunz is new partner at TIMES Attorneys

We are delighted to announce the appointment of Dr Mirjam Koller-Trunz as a new partner of Times Attorneys. She takes up the new position as of 1 October 2023 after almost four years in our sports law department. Mirjam Koller-Trunz is a successful lawyer and has an impressive expertise in sports law. She advises and represents clients in disputes before public authorities, state courts as well as arbitration tribunals . After her studies at the University of Zurich, from 2013 to 2015 she worked as an assistant at the chair of Prof. Dr. Ulrich Haas. During that time she was an ad hoc clerk at the Court of Arbitration for Sport and wrote her dissertation in the field of sports law. Before becoming an associate of TIMES Attorneys she worked as a trainee and – following her admission to the bar in 2018 – as an attorney-at-law at the top ranked Swiss law firm Bär & Karrer AG in the team “Media, Entertainment & Sports”. Since 2021, Mirjam Koller Trunz is an Ethics and Disciplinary Inspector at UEFA as well as a member of the Disciplinary Commission of the Gymnastics Ethics Foundation.
